Terms and Conditions

Please ensure you read and understand all the following Terms and Conditions. If you have any queries, please do not hesitate to contact us for clarification before you sign the booking form.

1 Contract
A contract exists when the property owners have received the deposit and signed booking form and confirmed your booking in writing or email. This contract is between the property owners and the lead guest who accepts these terms and conditions on behalf of all persons named on the booking form, including those substituted or added by agreed amendment.

2 Guests
The lead guest must be a member of the party occupying the property and must be over 21 years of age.
Only those persons named on the booking form are authorised to use the property. Any changes to the persons booked to occupy the house must be notified to and confirmed by the owners before occupancy commences (This is a requirement of Florida State Law). The legal maximum occupancy for the villa is 10 persons (including infants).

3 Booking Deposit
A non-refundable booking deposit of £150 or $250 per week is required to secure your booking. On receipt of this deposit and signed booking form your booking will be confirmed. The additional total rental costs plus security deposit will be required 10 weeks prior to the start date of the rental. If the booking is less than 10 weeks before the start date then the full payment is payable at the time of booking, along with the security deposit. We reserve the right to treat the booking as cancelled if we do not receive the balance by the due date, cancellation charges will then apply.  

4 Security Deposit
A security bond of £200 or $350 is required 10 weeks prior to the start date of the rental; this will be held by the owners or Management Company against loss or damage occasioned by the use of the property by the parties to this agreement. The security bond will be fully refunded within 28 days of your departure subject to a satisfactory damage/loss report being received from our management company and all Terms and Conditions being adhered to.

5 Cancellations
Any cancellation of a booking must be made in writing to the property owners by the lead guest and is subject to the following charges:
More than 10 weeks prior to arrival date – full deposit
Between 6 and 10 weeks prior to arrival date – 50% of the total rental cost
Less than 6 weeks prior to arrival date – 100% of total rental cost

6 Arrival/Departure
Arrival at the property must be after 4.00 pm local time. The property must be vacated by 10.30 am on the day of departure. Should you have a late flight it may be possible to rent the villa for an additional day, please enquire at time of booking.

7 Your responsibilities
The party must treat the property, its fixtures and fittings and other facilities with respect. The management company will check the property prior to your arrival and check the property on your departure. Any loss, damage or problems relating to the property or its contents must be reported to the management company immediately. The management company will endeavour to replace or rectify any loss or damage to the property or its contents or resolve any problems you may have as soon as practically possible.

8 Cleaning & Trash
The property will be cleaned prior to your arrival and after you have departed. If you require mid stay cleaning this can be arranged and paid for locally with the management company. The property must be kept in a clean and orderly state. Should the property require extensive cleaning then the owners or management company reserve the right to withhold any monies from the security bond to pay for the extra cleaning.
Trash collections are twice per week, the actual days are listed in the owners manual in the property.

9 Swimming pool & Spa
This villa has a swimming pool & spa. Swimming pools, spas and the surrounding areas are potentially dangerous. Guests are specifically requested not to allow children to use the pool, spa or surrounding area unsupervised, not to swim or use the spa unaccompanied and not to swim or use the spa under the influence of alcohol, medication or other mind altering substances. The owners or management company do not accept liability for any accident, injury or death, howsoever caused, as a result of the use of the pool, spa and surrounding area.
There are alarms on all doors and windows leading to the pool/spa area. These alarms must not be tampered with or in any way disabled. This is a state requirement and can result in a $5000 fine if not adhered to.

10 Insurance
We strongly advise that all guests have appropriate travel/holiday insurance, including adequate medical cover for the U. S., for the duration of the trip.

11 Smoking
We have a strict NO SMOKING policy inside the house. Guests are welcome to smoke on the pool deck, provided that ashtrays are used and stubs are disposed of carefully.

12 Force Majeure
The owners or management company do not accept any responsibility or liability for any loss or damage or alterations to the terms of this booking caused by events beyond the owners control including, but not restricted to: Riots, Political unrest, Hostilities, War or threat of war, Terrorist activity, Adverse weather conditions, fire, Closure of airports, Industrial dispute or any other event beyond the owners control.
